Often yes, but coastal lots add a step. State law says ADU rules apply in the Coastal Zone, and where a certified local coastal program covers ADUs, the city must approve or deny the coastal permit within 60 days without a hearing. Carlsbad's new 2026 ordinance is still pending Coastal Commission certification inside its coastal zone.

How Does State ADU Law Apply in the Coastal Zone?
The state housing department's March 2026 ADU Handbook says ADU laws apply in the California Coastal Zone but do not lessen Coastal Act resource protections. Where a certified local coastal program contains ADU provisions, the city must decide a coastal development permit for an ADU within 60 days, without a public hearing.
That 60 day timeline applies when there is an existing primary dwelling and a completed application (HCD ADU Handbook, citing Government Code 66329, retrieved October 29, 2026).
Coastal resource rules, such as bluff setbacks and public access, still apply. A lot can qualify for an ADU and still face a smaller footprint because of them.
What Does Carlsbad's 2026 ADU Ordinance Allow?
Carlsbad's Ordinance CS-506, adopted February 3, 2026, sets ADU size, height, and parking rules. In the coastal zone it takes effect only after the Coastal Commission approves the related Local Coastal Program amendment, and the city's code site marked it pending coastal certification when we read it.
Under the ordinance, an attached ADU may be 50% of the primary dwelling's floor area or 1,200 square feet, whichever is less, but not less than 800 square feet. A detached ADU on a one family lot may be 1,200 square feet, and a junior ADU 500 square feet (Ordinance CS-506, retrieved October 29, 2026).
Some news coverage described the attached limit as the greater of the two numbers. The ordinance text says less, so we follow the ordinance.
Rooftop decks are not allowed on ADUs. Replacement parking is generally not required when a garage is converted, except west of the rail corridor and in the area between the rail corridor and Interstate 5 from Avenida Encinas to Batiquitos Lagoon. ADUs must also be consistent with geologic setbacks in the Local Coastal Program.

What About Encinitas and SB 9?
Encinitas has its own ADU rules and Local Coastal Program, and SB 9 projects have their own limits. We could not open the city's ADU and SB 9 pages, so most Encinitas specifics are left out. One relayed point: an ADU in the Encinitas Coastal Zone requires a coastal development permit (relayed, City of Encinitas).
Ask the Encinitas Development Services counter for the current ADU and SB 9 standards for a specific parcel, and get the answer in writing during escrow.
On short term rentals, our general experience is that most of San Diego County now faces a 30 day minimum stay, and the rarer exceptions tend to be in the coastal zone and outside an HOA. That is general guidance, not a rule for your address, and we do not promise rental income. Confirm the current city STR rules and the HOA CC&Rs for the specific property.
Coastal ADU Due Diligence
- Confirm whether the parcel is inside the coastal zone.
- Ask the city whether its local coastal program contains certified ADU provisions.
- Check geologic setbacks and any bluff or slope limits.
- Confirm sewer, water, and electrical capacity for a second unit.
- Read the title report for easements or recorded restrictions.
- Book a planning counter or architect consultation before contingency removal.
What Should I Check Before Buying a Lot for an ADU?
Check zoning, coastal zone status, geologic setbacks, utility capacity, and any recorded restrictions before you remove contingencies. A short paid consultation with an architect or the city's planning counter during escrow is often the cheapest way to learn what a specific lot can realistically hold.
Rules on ADUs change frequently, and Carlsbad's coastal provisions were awaiting certification when we wrote this. Recheck the status on the date you rely on it.
Frequently Asked Questions
Here are direct answers to the questions buyers ask us most about this topic. Each answer is based on the sources listed below, retrieved October 29, 2026. Where a detail depends on your situation, the answer says so, and we are glad to walk through yours in a short conversation.
Do state ADU laws apply on coastal lots?
Yes. The state's March 2026 ADU Handbook says ADU laws apply in the Coastal Zone but do not lessen Coastal Act resource protections. Bluff setbacks and other coastal rules can still shape what you build.
How long does a coastal permit for an ADU take?
Where a certified local coastal program contains ADU provisions, state law says the city must approve or deny the coastal development permit within 60 days of a completed application for a lot with an existing home, without a public hearing.
How big can an attached ADU be in Carlsbad?
Under Ordinance CS-506, an attached ADU may be 50% of the main home's floor area or 1,200 square feet, whichever is less, but not less than 800 square feet. Coastal zone provisions were pending Coastal Commission certification.
How tall can a detached ADU be in Carlsbad?
Carlsbad's ordinance allows 16 feet, or 18 feet within half a mile of a major transit stop plus up to 2 more feet to match the main home's roof pitch, for a maximum of 20 feet.
Can I put a roof deck on an ADU in Carlsbad?
No. Carlsbad's Ordinance CS-506 states that roof decks are not permitted on ADUs. Ask the city about other outdoor space options during your design review.
